Welcome to Yawny (the "App"). These Terms and Conditions ("Terms") govern your use of the App. By downloading or using the App, you agree to be bound by these Terms.

1. Description of Service

The App is a freemium white noise application providing ambient sound loops. Basic features are provided free of charge, supported by third-party advertisements. Premium features, expanded sound libraries, and ad-free access require a paid monthly or yearly subscription.

2. Subscriptions and Billing

  • Auto-Renewal: Subscriptions are billed on a recurring monthly or yearly basis depending on the plan selected. Payments are charged to your Apple ID account at confirmation of purchase.
  • Automatic Renewal: Your subscription will automatically renew at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Cancellation: You can manage or cancel your subscription at any time by going to your Apple ID Account Settings on your iOS device after purchase.
  • Refunds: All billing, cancellations, and refunds are handled entirely by Apple Inc. through the App Store. We do not have the authority to issue refunds directly.

3. Intellectual Property

All audio tracks, sound loops, graphics, user interfaces, and code contained within the App are the exclusive property of Vainly Ltd. and are protected by copyright laws. You are granted a limited, non-transferable license to use the sounds for personal, non-commercial relaxation or focus purposes only. Resampling, distributing, or selling our audio content is strictly prohibited.

4. Disclaimer of Warranties

The App is provided on an "as-is" and "as-available" basis. While our sounds are intended to aid relaxation, sleep, or focus, we make no guarantees regarding health outcomes, nor do we guarantee that the App will cure sleep disorders or medical conditions.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Vainly Ltd. shall not be liable for any indirect, incidental, or consequential damages resulting from your use of, or inability to use, the App.

6. Governing Law

These Terms are governed by the laws of England and Wales.
